1. Introduction
1.1
Final Key Interactive AB, reg. no. 559511-2219, (”Final Key”, ”we”, ”our” or ”us”) is the data controller for the personal data processed in connection with recruitment and appointment of positions, which means that Final Key is responsible for how your personal data is collected, processed and erased once the purpose of the processing has ceased. This privacy policy (the ”Policy”) describes how we collect, use, store and protect your personal data when you apply for a position with us or register your interest in future employment, or as a designated reference from a job applicant, as well as your rights.

Your personal integrity is important to us at Final Key and we are committed to protecting your personal data and respecting your privacy. Final Key therefore processes your personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (the ”GDPR”) and other applicable legislation for the protection of personal integrity and your personal data. We strive for transparency and clarity in how we process personal data and in how we ensure that our processing complies with current legislation. "Personal data" means any information that directly or indirectly can be used to identify a living natural person.
2. Personal data processed
Job applicants
2.1
Final Key processes personal data that we receive in connection with recruitment and appointment of positions, i.e. personal data that you provide in your application documents and that we obtain from other sources in connection with you applying for a position, submitting an unsolicited application or registering your interest in future employment with us. Personal data processed includes, among other things:
Identity and contact details, including name, address, email address, telephone number.
Application documents, including CV, cover letter, education, educational certificates, work experience, employment certificates, any photograph and other documents you attach to your application.
Information provided or emerging from interviews and recruitment tests, including answers to questions, assessment notes and test results.
Information provided by references you have designated yourself.
Information that is publicly available on public websites/databases, e.g. via LinkedIn and Facebook or other public sources.
2.2
We ask you not to provide any sensitive personal data in connection with your application, e.g. information about health, ethnic background, political opinions or religious beliefs. If such information is nevertheless submitted, we will handle it with care and in accordance with Article 9 of the GDPR.
2.3
Your provision of personal data is not a legal requirement but is necessary for you to be able to apply for employment with us and for us to be able to consider you as a candidate for a position.
Person designated as a reference
2.4
Final Key also processes personal data about references provided by applicants in connection with job applications. The personal data that is exclusively relevant in this context is name, email address, relationship to the job applicant and any title and employer.
2.5
As a reference, you will be contacted by email or telephone and informed that an applicant has designated you as a reference. You always have the option to choose between remaining as a reference or declining, in which case your personal data will be erased in accordance with clause 3.2.1 below.
3. Processing of personal data
3.1
Purpose and legal basis for the processing of personal data
3.1.1
Final Key only processes personal data if there is a legal basis and a determined purpose for the processing.
3.1.2
National identification numbers have a particularly high level of protection under the GDPR and are processed by Final Key on the basis of consent, to fulfil a contract or where, having regard to the purpose and the importance of secure identification, it appears necessary and justified. The general rule is that Final Key does not process national identification numbers, except where national identification numbers appear in the documents you attach to your application or otherwise provide to us. You are encouraged to omit national identification numbers from the documents you send to us.
Job applicants
3.1.3
We process your personal data in order to assess and consider candidates for our positions and to administer the recruitment process and appoint positions. The processing is based on our legitimate interest in being able to recruit personnel for Final Key's operations and your legitimate interest in being able to obtain employment with us.
3.1.4
We also process your personal data in order to fulfil our obligations and exercise our rights under employment law, i.e. on the legal basis referred to as legal obligation.
3.1.5
If you consent to us continuing to process your personal data after the conclusion of a recruitment process, the data will be stored in our candidate database for the purpose of being able to contact you about future employment and career opportunities.
Person designated as a reference
3.1.6
The purpose of processing your personal data as a reference is to enable the job applicant to strengthen their position in the recruitment process. The processing of a reference’s personal data is based on our legitimate interest in being able to verify and assess the information provided about a job applicant by you as a reference.
3.2
Retention period for your personal data
3.2.1
The personal data that Final Key processes in connection with a recruitment process is retained for two (2) years after the conclusion of the recruitment process in order for us to fulfil our obligations and exercise our rights under employment law, e.g. the Swedish Discrimination Act (2008:567). If you as a reference choose to decline when asked by us, your personal data will be erased without undue delay. In addition, personal data may be retained for a longer period if required to fulfil obligations under applicable laws, regulations or government decisions, or for us to defend ourselves against legal claims.
3.2.2
If you have given your consent to your data being retained after a recruitment process and/or processed in our candidate database so that we can stay in touch and inform you about future positions and career opportunities, we process your data for this purpose until the earlier of you withdrawing your consent or the purpose of the processing ceasing. You may withdraw your consent at any time by contacting us.
3.2.3
If Final Key ceases to exist, e.g. through a liquidation or bankruptcy, your personal data will be erased unless it needs to be retained to fulfil obligations under applicable laws, regulations or government decisions.
3.3
Sharing of and access to personal data
3.3.1
Final Key applies the principle of access minimisation, meaning that personal data is only shared to the extent and with the personnel who need such access to fulfil the purposes listed above.
3.3.2
We engage external service providers who perform assignments on our behalf and who may process personal data, e.g. in respect of our IT systems and software. External service providers generally have access to information that exists and/or is generated in the systems that the service provider provides, but may only process personal data when it is necessary for the service provider to be able to provide its services to us.
3.3.3
Personal data may also be shared if it is necessary for us to fulfil a statutory obligation or to comply with decisions by authorities or courts.
3.4
Transfer to third countries
Final Key strives to only process your personal data within the EU/EEA. If in any case we are required to transfer your personal data to a country outside the EU/EEA, e.g. when using a service provider domiciled outside the EU/EEA, we or a subcontractor ensure that your personal data is subject to an adequate level of protection by implementing appropriate safeguards.
3.5
Cookies
If you apply for a position via our website or a digital application platform, we may use cookies and similar tracking tools to enable the platform's functionality and improve your user experience. Data collected from cookies may also constitute personal data. Information about which cookies are used, for what purpose and how long they are stored can be found in our cookie policy, which is available on our website.
3.6
Automated decision-making and profiling
Final Key does not make any decisions based solely on automated processing, including profiling, which produce legal effects concerning you or similarly significantly affect you. If digital tools and services are used during the recruitment process, a human assessment is therefore always made before any decision is taken that affects you.
3.7
Security measures
It is important to us that your personal data is protected. We therefore take all appropriate technical and organisational security measures required to protect personal data against unauthorised access, disclosure, alteration or destruction. If we engage an external provider on our behalf, we ensure that the provider applies corresponding technical and organisational security measures, that personal data is only processed in the manner we have approved and that a data processing agreement is signed before the service is used.
4. Your rights
4.1
Responsibility
As data controller, Final Key is responsible for ensuring that your personal data is processed in accordance with applicable data protection legislation, and that you can exercise your rights in accordance with the GDPR.
4.2
Right to information and access
As a data subject, you have the right to receive information free of charge about which personal data about you Final Key processes and how. Final Key provides this information primarily through this Policy but also by responding to direct enquiries from you.
4.3
Right to restriction, rectification and erasure (’the right to be forgotten’)
Final Key will, without undue delay, at your request or on its own initiative, supplement, rectify or erase personal data that is not up to date, inaccurate, incomplete or processed in violation of the purposes stated above or relevant legislation. You may also request that we restrict the processing of such data.
4.4
Right to data portability
You have the right to receive your personal data in a structured digital format and you have the right to have your personal data transferred to a third party designated by you. If technically feasible, we will carry out such a transfer directly. The right to data portability requires that the processing is based on your consent or on a contract.
4.5
Right to object
If we process personal data to carry out a task in the public interest, as part of the exercise of official authority or following a balancing of interests, you have, under certain conditions, the right to object to our processing of your personal data. We may then only continue to process your personal data if we have compelling legitimate grounds that exceed your interests. You always have the right to object to the processing of your personal data for direct marketing purposes, upon which we are obliged to cease the processing for such purposes.
4.6
Right to withdraw consent
You have the right at any time to withdraw all or part of any consent you have given. Following such a request, Final Key will immediately cease the processing to which the withdrawal relates, unless another legal basis for the processing exists. Requests to withdraw consent can be sent to contact@finalkey.se.
4.7
Right to lodge a complaint
If you are dissatisfied with our processing, you may lodge a complaint with the Swedish Authority for Privacy Protection (https://www.imy.se) or with the supervisory authority in the country where you live or work.
